Burn Pit Lawsuit - Home

Plaintiffs across the country have filed numerous lawsuits which have been consolidated in the United States District Court for the District of Maryland. In Plaintiffs’ First Consolidated MDL Complaint they allege U.S. soldiers, National Guard personnel, contract employees and others serving our country in Iraq and/or Afghanistan are suffering from chronic illnesses, serious diseases, an increased risk of developing serious diseases and an increased risk of death. The plaintiffs allege that these injuries are caused by overexposure to harmful toxins and carcinogenic materials in the smoke and ash generated through the improper disposal of vast quantities of unsorted waste in enormous open-air burn pits.

Plaintiffs' allege the management of these burn pits was the contracted responsibility of Halliburton Company; KBR, Inc.; Kellogg, Brown & Root Services, Inc.; and Kellogg, Brown & Root LLC. These companies have been named defendants in lawsuits consolidated as the In Re: KBR Burn Pit Litigation MDL.

The military has been slow to acknowledge the numerous health problems allegedly associated with the contractor-managed burn pits. They have also been slow responding to requests for information and facts that the plaintiffs, their own veterans, have requested. In the Motion to Dismiss filed by Halliburton/KBR, they have stated “The military, not KBR, decided which method of waste disposal to utilize at a particular base camp."

Congress and President Obama have taken note of the issue - for example, H.R. 4477 was introduced by Congressman Tim Bishop – NY, that would restrict the use of burn pits.
